It is that time of the year again. Immigartion reform is in the air. Recently there were raids on many businesses and arrests ensued.The Bush administration is showing its zeal to pursue the 'illegal immigrants', 'Undocumented workers'.The pro-immigration and anti-immigrantion organizations are racheting up their activities. You would hear a common refrain from the anti-immigration ideologues like 'If they want to come to this country, let them come legally'. So let's see what the people trying to immigrate legally face.
A major category of the people who immigrate to America come through a channel known as 'Employment Based' immigrants. They constituted almost 16% of the total immigrants to United States in year 2005. The immigration
process consists of three steps
1. Labor Certification - The US Department of labor administers this program. This process takes anywhere from 3 to 5 years. There are people in this queue who had applied for certfication in 2001. Now imagine waiting that long for the first step.

While some members might have jumped too hard on the whole thing, Some stuff goes unanswered.
1) Why has not USINPAC endorsed IV all this while on their website? Does not USINPAC know any thing about IV?
2) While I understand the importance of fund raisers for politicians, why USINPAC has not involved US citizens of American origin to contribute to the cause? What about grass roots efforts?
3) I dont have the exact statistics, but I am positive that every one out of 2/3 Indians living in the US is plagued by this problem of GC. How come Orgs like USINPAC are not pushing this by all means?

I personally am neither defending the outrage of some members nor appreciating it, but most of the Indian American citizen community does not want to be in sync with the plight of Indians immigrating to US.There are various reasons. Most important one as I have seen, Many in the Indian American citizen / Indian Permanent Resident community run consulting companies and they would hate to see these guys slip away from their hands by getting GC's. Fcuk, its like the damn door closes right behind you. I am positive most of those shops will come down to earth if Indian citzens start getting their GC's. May be its time, the Indian American Citizens/ Indian PR's ask themselves, what they really want. I have been to some Indian regional association meetings and the big guys or folks from my generation ahead would love to see their kids get married to an Indian or would love to see their kids grow with the rich heritage, but damn it, they just want it to happen with out doing any thing.

I know, it is unfair and frustrating. But from legal point of view, you are mixing Employment Laws with Immigration Laws.

When does the "Approval notice sent" status appear, it is about 7 days since I got the production ordered.

My EAD is pending for 8 months due to security clearance. I requested interim EAD but no luck. Have made several info pass appointments, the IO called Texas Service Center and spoke to the officer who has my application. the Texas service center replied to local IO that they will soon get to it. As of January 11, 2008 my application is sitting on the desk of the IO in Texas waiting to be adjudicated. However, with pending security clearance I am not sure when that would happen....Biometrics were done in July 2007.
Any advise is greatly appreciated

Guys we are seeing some contributions like 20$, 30$ anything is better than nothing, but please understand the cause we are fighting for. It is very urgent for all of us(including yourself). Thats what my Question is......how i am gonna prove it i paid 3k for my H1. They are deducting 500 (for my H1) everymonth from my paycheck in the name of CASH ADVANCE DEDUCTION.
I really want to teach them a lesson....so that they stop messing many vulenerable people like me who go to them every year. Could somebody tell me how i am gonna complain DOL in new jersey about this company and does DOL really takes any action.
Greencard is not i am much looking for......i am planning to go back to india after 2-3 years.

If you want OCI, there are a few hoops to jump through -
1. Apply for an Indian passport first.
2. Once the Indian passport is issued, apply for the US passport.
3. Return the Indian passport after the US passport is issued. The consulate should return the Indian passport back to you, but keep a photocopy in case they don't.
4. Now you can apply for OCI on the grounds that your son once held an Indian passport.
His child is born in USA and thus his child is US Citizen and so he can only apply for US passport. He can not apply for Indian passport for his child.

I don't know how to open a thread to run a poll to track the number of people ready to send flowers to white house/president to highlight our case to buy houses if there is a a provision to approve GCs on a fast-track basis. With a substantial fast track fee (>4000 dollars) and 20% down payment toward house payment, we have a strong case. If we get hundreds of people ready to send to flowers, may be IV can make it an action item.
In overall picture of the country for housing and financial fix, number of EB's waiting for GC is miniscule. Giving every EB waiting a GC is not going to instantly change the mindset of the rest of the US people. People are not buying homes, because those who would have bought homes in 2008, 09, 10...bought in 2005 and 2006, as they didn't want to be left out, moving demand forward. Now we have a lot more homes and demand for years to come. Home prices will stay soft for at least 5 years.

All the suggestions are good but think who gets to influence USCIS more ? It is the EMPLOYERS.
Action Items are:
1. We let our employers know the current issue
2. Notify AILA , MEDIA that we are boycotting work or taking leave for a day or a whole week. This is the same day everyone takes leave and notifies the employer that they should do something

What if USCIS doesnt return the applications , and releases a press note ,s aying that all applications are being accepted , but they would be processed later (not approving EAD and AP). That would be creating more havoc in our lives.
I personally feel a very likelihood of this. After the lawsuit, they can negotiate that all right, we are not going to reject any application becuase it is going to create problem for the customer so we are just going to hold it but will not process until the visa is made available. They can simply kill 2 birds with one stone. Hope they don't ready my post and come up with this idea. ;)

Does any of you trade in Indian shares? If so, did you have to open the PIS NRE account to do trading in Indian shares ? I heard that NRI from USA can not use the normal demat account to do the trading in secondary market in India.

Let's say, I am not able to do that. But, do you suspect that they might APPROVE my 485 BEFORE my PD gets current? If they don't then, I am in no trouble, isn't that right? If they don't approve, then, I can add her into AOS when my PD gets current again assuming I don't file for EAD (I won't - I like my employer for now).

You are absolutely correct, u did not miss anything.

- front and back of current EAD card
- 2 photos (make sure to write A# and name at the back using a pencil)
- check payable to US department of homeland security
- file it correctly to the right service center (dont worry if the address is different than what u filed last time)

- Just make sure A numbers are written properly everywhere.

My case exactly like yours. Mine expires on Sep 24 th. E-filed on may 28th. FP'ed on June 23rd. Concurrently filed APs got approved long back.
I think Info Pass is the best solution for this. You have only a few days for that. So hang on.
I am planning to take info pass too. But to ask for expedite request, I think 90 days should have passed since application sent.
My Above mentioned EAD is approved today. I got the Card ordered mail from CRIS today at 7 pm...

I do make a clear distinction between good players and bad apples. If you cannot understand, let me know I will put it in simple words!!! Doh!!!
I don't see that "some" word either in the title or the content of the thread. The point is you are trying to color all companies in the bad light for your own satisfaction. I guess you work for one of the direct companies.

Yes, GC is not life, we might back to our country still with good quality life. But deported by this piss-off reason, We really can't be ease.
Just meet some prideful but stupid local American, can't depend on their intelligence. Just like my wife tried to explain we don't speak English at home to refute that ridiculous "help" shouting, but the leasing office ass manager question, "Why you speak English with me now??? " How can I comment? "Can you understand if I said my native language?" Finally we have to find a new apartment in 3 days.

I think you need a second opinion from a lawyer, no one here can really help you (unless he/she is a lawyer).
If your version of the story is really the absolute truth (assuming there is no wrong doing on your part) then you should fight, the system is fair (I'm sure people understand language barriers) and I'm sure judgment will be in your favor.
Just a word of caution... Don't underestimate the intelligence of people making the judgment, they deal with such cases everyday - they can easily smell a rat.
GC is not life, the trial verdict can change your life for better or for worse (specially if there is jail time involved).
