Hi,
I applied for H1 and H4 for my Family in 2005. I was working on L visa that time. Our H1 and h4 got approved in October 2005 but we were in India that time. We came to US again on L Visa in 2006.
After coming on L visa my new employer applied for my H1 change of status again in 2006 but not for family. Their H4 from 2005 was valid till 2008.
But Now while I am changing my job, New attorney says that my family is out of status and because we did not file H4 for them again.
What is the alternative to bring them in status. They have vaild i-94 from L2 which is valid till 2009 and they have approved h4 from 2005 which is valid till 2008.
Now my new employer have started my H1 transfer. I am thinking that for my family I will apply H4 change of status once my approval comes. Is that Okay or there is any other alternative to bring them in the status.
My family can not travel to India for H4 stamping till the end of this year. My wife will be delivering a baby in October. Will there be any problem for my new born baby for the passport?
Please advise.

Someone mentioned regarding birth certificate. I have the birth certificate which was issued by Indian Consulate. Will that work or do we need the Birth certificate from Municipality office ? Do i need to get affidavit

I think all the backlogged labor applications are going to clear. But people like you may get very less time to apply maybe 15 days. My advice to you.
Start preparing to apply if you have not started already.
1. Do your medical exam. It is valid for 1 year.
2. Collect important documents. Birth certificate is most important.
Has to have .
a. In English
b. Need to indicate that has been prepared from original registration record.
c. Need to have your name,both parents names,
d. Registration date with date,month,year.
3. Fill up your forms.
Dont be dejected.This is the time for action.
Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.

If you think renting is not 'quality of life' and you see it is affordable and prepared to lose money go ahead and buy. On the other hand, if you don't mind renting and don't feel like losing your hard earned money wait for the downturn to be over.
The rate of fall is so much that it is better to lose on the rent than buy and lose over the next years depreciation.
My interest in the house would be long term investment rather than quality of life. Another point is that most people are unwilling to spend lot of money on rents to get the same QOL. There is emotional element there called (eventual) 'ownership' but that's only emotional. That I don't care about too much.
If the trend indicates prices are falling this year, I guess people will wait for a year more but at some point people will go ahead, depending on the overall economy start buying because no one can really predict the bottom. At that point, it may even start going up allowing the economy to slowly get back on its feet.

If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs .

It is US INS responsibility to ensure no one (mostly Indian IT companies and small companies in US operated from bedrooms, not basement or garage!! :) those created in garage are HP and GOOGLE) can exploit it. So blaming TCS and WIPRO and INFY and PATNI is not enough!! If we don't protect our house and thief exploits that to rob us that is our fault. This holds true for US INS too. And don't assume INS didn't know this. No exploitation is possible without Govt's active or passive approval. This is one big ecosystem and all have their share. That is how all businesses are operated across the world. Immigration is one of the biggest businesses here. And they want this chaos to exist for their interests.

I would trash the PR, i mean let it expire and you be on your way. Cdn PR doesnt gives much benefits unless you want to settle in Canada/ work there.

Just today, the May 2008 visa bulletin is out and lot of discussions are going on in various threads in this Forum. Just got the mail Card production ordered(myself, spouse , dependent).
Raised SR on 2nd May Got RFE on 3rd , received the RFE(Employement Verification) on 8th.
replied the RFE , USCIS received on 12th.
