NK2006 thanks for the post my family and I recently entered US using AP and fortunately we were not questioned at POE. I am in similar situation waiting for 485 and filed AC21 when I changed jobs after six months.
That is not to say that we will not have problem in future. You mention your wife showed them a copy of rules pertaining to AC21. Can you post a link or post them here.
My lawyer never advised me to carry any such documents.

Guys,
I applied in Feb 2006..My H1 Expired in Dec 2006. Canada ppl came back saying H1 should be valid for at least 1 year.
Now when I get my H extension and reapply - can I use the same Police clearance from Indian Embassy and FBI that was sent in Feb 2006?
ANy clues?

I think you should go to either Eatentown( Exit 105 on GSP). Before they started accepting all immigrant applications at all DMVs they used to ask every one to go there. I think you may be able to get a temporary extension for month or two.

I understand that you guys have done a lot with limited resources, but trying to isolate yourself from the issue of illegal immigrants issue is not going to help us either. We need to use the momentum of illegal issue to sneak in our provisions (which we already have with the advance degree provision, exception of spouses from cap,capture of unused visa numbers).
I think you are wrong in stating that I do not grasp the issue that AILA is only interested in illegal immigration issue and not in EB3 retrogression. I know that more than you can imagine, which is why I have been urging the forum to stop asking every one to fax the senators with requests to remove hard limits by country or even concurrent filing of I145 when visa numbers are not current. I read on post by a junior member where that person DID GET A CALL BACK FROM ONE OF THE SENETORS OFFICE AND THAT GUY COULD NOT ARTICULATE THE ISSUE WHEN THE SENETOR ASKED HIM IF THE ISSUE WE ABOUT INCREASING H1-B�S.
Exactly what happens when thousands of people contact senators instead of one fax from one organization with one point of contact just so that if some one actually calls back from the senator�s office we at least have some one who could explain the situation in a way that makes sense?
Also, I know how difficult it could be to get an amendment in just as well as you and I also know the fact that the real interest is in solving the illegal immigrant�s issue. The reason for that is the issue that the U.S has is with ILLIGAL IMMIGRATION. The EB retrogression is really our problem, not some thing that is going to raise alarms in the senate. Which is why any amount of hue and cry is not going to change the situation? We should be glad that the advance degree provision, recapture of unused visa numbers and exemption of spouses from cap will make way for a few people and in the process clear up the backlog in EB3 category. i have couple of questions.
1. currently i am on H1 and my wife started using EAD. First time i applied EAD and AP for both myself and my wife. Now, i don't want to renew my EAD but just renew my wife's EAD. Is this ok? What happens to my EAD after it expires. Will i be able to renew it in future or will i be able to apply for a fresh EAD based on my pending 485 with out a problem? what will be my status if i renew my wife's EAD alone with out renewing mine. will i still be on valid h1?

I guess the same would go for Wu, Yu, Zhou, Singh, Kumar etc.

My only concern is AC21 letters not getting into your file and USCIS issuing a NOID or a denial.
Other than notifying CIS of our job change, there is nothing else we can do. If it results in a denial, it is easy enough to reverse that, so I would not worry about it.
I am changing jobs in 2 weeks. As I said earlier, I am prepared for my employer revoking the 140 and CIS denying my 485 by mistake. At this point, I am not even bothering to notify CIS about my job change.

I used the provisions of AC21 and changed jobs in early 2005. FOIA requests will work for your I-140. I-140 is filed by the employer on your behalf and is therefore your paperwork.
It took approximately two and half months to come through.

Why don't we mail copies of our degree certificates, diplomas and other credentials? They will know who is more educated..Lou Dobbs or us !!!

The issue at hand is not to "prove" if you are educationally qualified rather long delays in legal employment based immigration. So sending copies of degree certificates may not convey our message. Also, if we wrap the stoppers in the photo copies of the degrees that might show subtle disrespect to American learning institutions that gave you those degrees. On the contrary, these degrees are to be framed, if you want to. We want positive message e.g. stop reverse brain drain.
Stopper is a good idea because it weaves two ideas very effectively:
- Stop American jobs from off-shoring : use a stopper
- Stop reverse brain "drain" from America to keep America competitive : use stopper
