    One of my friend asked Shiela Murthy and she said that in order to be able to add my spouse , I would have HAD to get married before July 31st (which I couldn't anyway), because, then, only I/we will be eligible to add my spouse.

    Also, I sent in the papers for my I-485 last night. Now, hoping to god that there is an RFE on this and some kind of delay.

    double-check that note from Sheela Murthy (take an appointment with either her, or Rajiv Khanna). You have to get married before your 485 is approved, dont know whats that July 31st date. Good thing you filed your 485 atleast. You can add your spouse only when your PD is current, but you can atleast use AC21 in the meantime (for changing employers etc).

    To summarize the INS position, as long as the principal applicant gets married prior to the INS' approving the I-485 application, there should be no problem for the dependent/s to either file the Adjustment of Status, if in the U.S., or to "follow to join," based upon a consular interview abroad. Therefore, the principal can file the Adjustment of Status application prior to marriage, but the marriage needs to take place before INS makes its decision on the I-485 application.

    I do not believe original employer was involved in any Fraud but he did have financial trouble ( paying salary after 2 months , check bounce etc - that is the main reason I left) .
    That company is MSU software based in Iowa ( just in case if anyone knows about it ) .

    I tried several times approaching USCIS as well as Congressman's office to find the details of delay / extended review status etc but all I got was we need to wait until the review is complete.

    I had switched attorney as soon as I joined company B and they AC21 and I have copy of the all the docs including the letter requesting to remove the old company A attorney . Also last my company B changed the attorney firm to a different one and they did sent a new G28 for that .

    I am kind of stressed until I see the letter which is going to be delayed because of the snow Storm :( .

    I know what you're going through. My own case got denied by someone who'd only been in the job for 2 weeks and she denied it because she said I didn't provide a document which was not only provided, but they had two copies! AND I saw it while she was fiddling with my file at the interview. Sometimes, it's just sheer back luck. So if you know you have everything you should have in your file, just chill. It's another bump in the road and it'll mean more waiting for you, but it's not the end of the world.

    Look guys, sorry for the outburst, and sorry Franklin. I thank you for all the efforts you have put in.

    But see, just because you did something good, does not mean you should look down upon others!! Doesn't that make sense? :confused:

    For example, how would others feel if, say, a person holding a MIT or IIT degree says "These other low end degree holders do not deserve GC before we get it first"? [ Now do not get started on quality of IIT/MIT degree, but it's perceived to be better by most people ], or people with a US degree says "These other indian degree holders should not get GC before we do".

    Not everybody could make it to DC, but I'm sure a lot of them supported the cause directly (signing the petition, calling senators, supporting financially etc.) or indirectly (digging stories, telling the collegues and encouraging them, spreading the word etc.). Nobody should HAVE TO give an excuse for not being at DC, and HAVE TO be looked down upon if they didn't go.

    What my point is, do not divide the community with "DC Goers" and "The Others".

    As for me, no I didn't go to DC, and I don't see any reason to tell everyone WHY [ but I sure hope nobody, NOBODY had the reason I have ].

    What is your point, Tnite? EAD and AP can filed/issued even if the PD is retrogressed. MY PD was retrogressed after I filed I-485 and EAD and AP were issued?

    my point is if dates retrogress and if processing EAD's and AP's takes a long time getting a EAD might be easy in the first 60-90 days but renewals will become more difficult.

    its ok for folks that are within their 6 yrs of H1b but for others it will be a big head ache. As someone already mentioned earlier, you might have to apply for your renewal EAD the day after you get your 1st EAD and so on.

    I think we should call and tell them that highly skilled legal immigrants are working for long time and the jobs are granted because there is a shortage of highly skilled immigrants in US. We are waiting just because of the inefficiency of USCIS.

    This legislation is similar to the measure that Sen. Robert Menendez (D-N.J.) used before Summer recess to hijack debate on E-Verify reauthorization. The bill�s sponsor, Immigration Subcommittee Chairman Zoe Lofgren (D-Calif), claims it would �recapture unused employer-sponsored visas� from as far back as 1991 and then add them to the current numerical cap of 140,000 employer-sponsored visas that are available each year. Current law, however, clearly states that any employer-sponsored visas not used in one year are allocated to the family-preference categories in the following year. That means that there are no �unused� visas from past years to �recapture.�

    Moreover, these extra green cards would be for foreign workers to take engineering jobs, health care jobs, construction jobs, manufacturing jobs and just about every other job that Americans have been losing in this economy. In order to qualify, a foreign worker doesn't need more than 2 years of on-the-job training � and they aren't even required to have a high school diploma. Our country doesn't need these workers - our workers need these jobs!

    Yes but in Canada you will breathe clean air and drink clean water. You will have electricity 24 hrs a day and water 24 hrs a day. You wont find trash on the street and you wont be considered second class citizen if you arent SC/ST/OBC due to reservations. You woint have to give "donations" to get your kid admitted to Class 1. You wont face a system where a simple court case drags to 50 yrs or a case where doctor will not treat if before police does a "Panchnama" if you had an accident. You wont have to bribe everyone from minucipality to police to start a business.


    Canada is already worse than India (atleast for IT sector). Hard to find jobs. Salaries are 75-80% of corresponding US jobs. And Candian $ is also cheaper (though catching up with USD).

    It is possible, but what's the point? It will have later receipt date. It is better to file a lawsuit to force the USCIS to issue EAD. It will cost only $350 :)
    Has anybody filed lawsuit against uscis for EAD delays till now ? And what is the process for this, do we need a lawyer ?

    This is just one example.There are millions of incidents which proves that GOD doesn't exist.

    This is my thought process (also referred by Ron G):


    July 2007 brought in approximately 500K 485 cases.

    We do not know how many cases were pending as of June 2007.

    Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
    Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers

    so, 500K - 300K = 200K.

    Assuming USICS approval rate is 85%; 75K of 500K are denied.

    200K - 75K = 125K EB cases pending from the July 2007 cases.

    Additions: from all current categories - may be 25 K in 2 years?

    So, 150 K plus whatever that was pending as of June 2007.

    So next fiscal year, 2009 if USCIS uses the quota 140 K, most or all of the 2007 filings will be cleared. If not EB3 I, definitely EB2 I and C, EB3 ROW will be cleared.

    Depending on new filings, EB3 I might retrogress but retrogression might come within 3-4 years instead of current 8 years.

    I strongly believe, beginning Jan 2010, dates for EB2 (I and C) will move forward heaps and bounds followed by EB3 ROW.

    (1) To carry out programs that provide education and training to establish nursing career ladders to educate incumbent healthcare workers to become nurses (including Certified Nurse Assistants, Licensed Practical Nurses, Licensed Vocational Nurses, and Registered Nurses). Such programs shall include one or more of the following:

    (A) Preparing incumbent workers to return to the classroom through English as a second language education, GED education, precollege counseling, college preparation classes, and support with entry level college classes that are a prerequisite to nursing.

    (B) Providing tuition assistance with preference for dedicated cohort classes in community colleges, universities, accredited schools of nursing with supportive services including tutoring and counseling.

    (C) Providing assistance in preparing for and meeting all nursing licensure tests and requirements.

    (D) Carrying out orientation and mentorship programs that assist newly graduated nurses in adjusting to working at the bedside to ensure their retention post graduation, and ongoing programs to support nurse retention.

    (E) Providing stipends for release time and continued healthcare coverage to enable incumbent healthcare workers to participate in these programs.

    (2) To carry out programs that assist nurses in obtaining advanced degrees and completing specialty training or certification programs and to establish incentives for nurses to assume nurse faculty positions on a part-time or full-time basis. Such programs shall include one or more of the following:

    (A) Increasing the pool of nurses with advanced degrees who are interested in teaching by funding programs that enable incumbent nurses to return to school.

    (B) Establishing incentives for advanced degree bedside nurses who wish to teach in nursing programs so they can obtain a leave from their bedside position to assume a full- or part-time position as adjunct or full time faculty without the loss of salary or benefits.

    (C) Collaboration with accredited schools of nursing which may include community colleges and other academic institutions providing associate, bachelor’s, or advanced nursing degree programs, or specialty training or certification programs, for nurses to carry out innovative nursing programs which meet the needs of bedside nursing and healthcare providers.

    (h) Preference- In awarding grants under this section the Secretary shall give preference to programs that--

    (1) provide for improving nurse retention;

    (2) provide for improving the diversity of the new nurse graduates to reflect changes in the demographics of the patient population;

    (3) provide for improving the quality of nursing education to improve patient care and safety;

    (4) have demonstrated success in upgrading incumbent healthcare workers to become nurses or which have established effective programs or pilots to increase nurse faculty; or

    (5) are modeled after or affiliated with such programs described in paragraph (4).

    (i) Evaluation-

    (1) PROGRAM EVALUATIONS- An entity that receives a grant under this section shall annually evaluate, and submit to the Secretary a report on, the activities carried out under the grant and the outcomes of such activities. Such outcomes may include--

    (A) an increased number of incumbent workers entering an accredited school of nursing and in the pipeline for nursing programs;

    (B) an increasing number of graduating nurses and improved nurse graduation and licensure rates;

    (C) improved nurse retention;

    (D) an increase in the number of staff nurses at the healthcare facility involved;

    (E) an increase in the number of nurses with advanced degrees in nursing;

    (F) an increase in the number of nurse faculty;

    (G) improved measures of patient quality as determined by the Secretary; and

    (H) an increase in the diversity of new nurse graduates relative to the patient population.

    (2) GENERAL REPORT- Not later than September 30, 2013, the Secretary of Labor shall, using data and information from the reports received under paragraph (1), submit to Congress a report concerning the overall effectiveness of the grant program carried out under this section.

    (j) Authorization of Appropriations- There are authorized to be appropriated to carry out this section for fiscal years 2012, 2013, and 2014, such sums as may be necessary. Funds appropriated under this subsection shall remain available until expended without fiscal year limitation.

    SEC. 4. COLLECTION OF DATA AND REPORTS TO CONGRESS ON FOREIGN-TRAINED NURSES NEWLY ADMITTED TO THE UNITED STATES EACH FISCAL YEAR.

    (a) Requirement To Collect Data- With respect to each fiscal year, beginning with fiscal year 2011, the Secretary of Homeland Security shall collect the following data for each alien that acquires the status of a lawful permanent resident or a temporary alien worker (including as a temporary professional worker under the North American Free Trade Agreement) during that fiscal year for employment as a professional nurse:

    (1) The country of residence and country of nationality of the alien at the time such status is acquired.

    (2) The country or countries in which the alien received the professional education and training to be licensed as a nurse.

    (3) The name and address of the petitioning employer.

    (4) The name and and address of any recruiting agency used by the petitioning employer with respect to the recruitment, processing or preparation of the alien for the employment involved.

    (5) The processing time for review and action on the petition with respect to each such aliens.

    (b) Research of Data From Prior Fiscal Years-

    (1) With respect to the fiscal years 2006 through 2010, the Secretary shall determine which of the data required to be collected pursuant to subsection (a) are available for retrieval in electronic databases maintained by the Secretary.

    (2) In preparing the report for fiscal year 2011 mandated by this section, the Secretary shall include a summary of all such available data for fiscal years 2006 through 2010.

    (c) Reports- The Secretary shall submit annual reports aggregating the data collected under subsection (a), and, with respect to the report for fiscal year 2011, such additional data identified pursuant to subsection (b), along with such related information as the Secretary determines to be appropriate, to the Committees on the Judiciary of the House of Representatives and the Senate not later than 90 days after the end of each fiscal year. Such reports shall include--

    (1) the aggregate number of aliens who acquired a status described in subsection (a) during such fiscal year and subtotals of the status categories acquired;

    (2) subtotals within each status category for the data element collected pursuant to subsection (a); and

    (3) the average processing times for each different type of petition or application involved in the acquisition of status.

    (d) Publication in the Federal Register- The Secretary shall cause to have published in the Federal Register notice of the submittal to the Committees on the Judiciary of the House of Representatives and the Senate of each report required under subsection (c) and of the availability to the public of each such report.

    I dont think we need to waste our time about such non competent organizations , let them take the credit , it just shows that this was a great idea. Looking at their website it does look like they have some good contacts .

    I think immigration voice should write them a formal letter and ask them to publicise this to their "contacts" ..

    If they got themselves into this picture well,lets put them to work!

    Really? Nurses are part of EB?? I was not aware of that. Which catagory EB3? EB2? Just curious. Either way i dont think the president is going to support this one.

    TSC I-765 for pending I-485 adjustment application is 'Feb 15th 2008'...last month it had 'Jan 29th 2008'...only moved 16 days...it is really weird...how much time they take to process may applications...mine will be expired on Aug 16th 2008...i am scared now..i am working on EAD.

    Bailouts from Arabian princes & Chinese govt. didnt do much squat to push the economy. A few immigrants buying houses (which again is gonna be tough to get loans approved in the 1st place) is gonna do much less good.

    The US economy needs a deep cleanse. Which means all the bad news has to come out once & for all. No more Congress sanctioned hush ups for irregularities at Fannie Mae etc etc.

    The US as a whole needs to rebuild the faith of the rest of the world, both politically & economically. It has now been clearly established that US is not a political & economical superpower that it once was.

    You will not have any problems since you already submitted AC21 documents (keep certified mail receipt with you).....so whatever your attorney said, it is correct....you don't need to worry.....even your employer withdraws your I-140 it won't be having any problem.....it happened in my case....I have sent AC21 docs....after that employer withdraws I-140.....but nothing happened to I-140

    "Ability to pay issue" is right in employer's view.....he can able show the ability for one more application if he withdraws your application.....

    How did you find your file was not updated AC21 docs..... better way is go to local USCIS and asked your attorney name whether it is the changed one or previous one if you have changed them.....call I800 and asked them few details like attorney name and company name etc..... see some times they won't reveal any info....you have to find out the way to get right answer (like tell them old attorney's name and say didn't get any updated information about your case etc)....

    I am in the same boat and my employer has decided that they will revoke I-140 no matter what. Can you tell me how did you find out that your employer revoked your I-140. Maybe he/they did not. But my firm is really big and they go by the rules. So I just want to know whenever employer sends the revocation, does USCIS always revoke or it is upto their discretion whether or not to revoke. Problem is I do not have a job yet so I cannot even file for AC21.

    I am also proud to live in such wonderful country who are open to any new talent and do not hesitate to honor anyone irrespective of their color,race and religion. I wish all countries take inspiration from it.

    I share your enthusiasm, for now. But it is not always like this, and will not be like this. So lets cherish these times. Great talent and greatness has been rewarded with obscurity, more often than not.

    Here is an example - Do you know who invented AC current, electric motor, laser, x-ray, radio technology, wireless technology, cellular technology, neon, remote control just to name a few. There is not a minute that goes by in the life of modern humans when we don't use inventions of this great man, but over 99% of all people don't know his name. Everyone will call Einstein a great scientist. But this is the greatest, and how come so less people know about him?

    Reason, he was not American, British nor a Jew. So history rewarded the greatest scientist with obscurity. And most of us don't know about him.

    The point is, great talent is not always rewarded as it should be. We think that we are talented and that's why we are on "special" visa. The fact is, we have chosen to be part of the system, that makes a rich guy richer. As long as you are in the business of making a rich guy richer, or as long as you are part of the system that makes more money for some hotshot powerful banker, we can all continue to live in this fool's paradise claiming that any new talent is always honored in this GREAT country.

    Yes, most Attorneys advise against proactive filing primarily because AC21 has no formal process associated like form, fee, reciepting or standard. It is based on guidance, most times the AC21 docs may or may not reach your file.

    Some Attorneys advise the HR to proactively file for AC21. There is one company (huge) where when you are being offered a job on EAD after AC21 - the HR dept makes a big fuss - asks for all documents like copy if Labor, 140, 485 reciept any any other documents and then makes you sign G 28 and then file for a G28 change in Attorney and associate AC21 docs with those. I guess, the Attorneys charge money so it is a business. If RFE or denial - then more money.

    My recomendation is to hire a ethical and realistic lawyer and not a greedy one

    Assuming that AC21 documentation does reach my file, is there any harm in it?
