This is not 100% relevant to this thread but since we are discussing APs here, I thought I will ask the question.
Do we need AP to go to / come back from US Virgin Islands? I know that these islands are U.S. territories and should be nothing more than going from one U.S. state to another. The reason for my question is that the DOS website states that for travelling to USVI, the U.S. citizens should carry a Photo Id AND Birth Certificate to establish the U.S. citizenship. Many websites state the same thing and some sites mention that this is because of nearby British Virgin Islands. As you can just take a ferry and come from British islands to U.S. Islands, the Immigration authorities on Mainland need to check your immigration status. This is not the case for travel to Hawaii or Puerto Rico.

The issue at hand is not to "prove" if you are educationally qualified rather long delays in legal employment based immigration. So sending copies of degree certificates may not convey our message. Also, if we wrap the stoppers in the photo copies of the degrees that might show subtle disrespect to American learning institutions that gave you those degrees. On the contrary, these degrees are to be framed, if you want to. We want positive message e.g. stop reverse brain drain.
Stopper is a good idea because it weaves two ideas very effectively:
- Stop American jobs from off-shoring : use a stopper
- Stop reverse brain "drain" from America to keep America competitive : use stopper
This concept of reverse brain drain is well documented by the recent Kauffman foundation study http://www.kauffman.org/items.cfm?itemID=906

Please watch your language. Its a valid question. If you and your spouse have good jobs here and children are in school....moving back to support your parents may not be so feasible both economically and also for many other reasons. Hi,
I had sent an e-mail to my attorney...below is his reply...looks like i will get my renewed EAD before current EAD expires.
USCIS typically issues new EADs within 90 days. If they don't, you may make an Infopass appointment to appear in-person at a local office to request that they process an interim EAD. The local office will not issue an EAD. Rather, they will contact the Service Center which will typically issue the EAD within two weeks.
Not sure if this rule still valid (some websites still has them , including murthy),

Few months back, 2 DMV officers gave me a tough time in CT. I wrote strong complaint and got a reply that, it will be allright if I go again and I went for the 3rd time and got it without hasstles.
Here is what happened
Dear Mr. XXXXX,
This reply is in response to your email of 5/20/06 in which you
describe
the difficult time you have had in obtaining a CT license. Please be
advised that if the documents are not acceptable when you return you
may
ask the Sergeant or Supervisor to complete a form for 'Review of Non-US
Citizen Documents'. In this process copies of your documents are
forwarded to our Branch Operations Division for further review. You
will
be notified of the outcome by mail.

them. My company sends me on work assignments to various clients all
over the United States. I recently started on a work assignment at
Pitney Bowes located in Shelton, CT. All this while when I am in United
States, I have worked in the states of Georgia, New York and Washington
and have obtained drivers licenses from all these states. I have
maintained legal status and always carry my documents whenever I
interact with a govt agency like DMV.
From the time I have started my work assignment in CT, I have
approached the DMV twice. Both the times I was turned back saying that
my documentation is not acceptable.
First experience:
DMV, Bridgeport, CT:
Issuing officer wanted a document from my employer that says that I
am still employed with them and have not switched employers. I asked
the
officer polietly if there is anything she is expecting to see in the
document (in terms of information like kind of work, nature of work,
place of work etc...) and she was very kind in explaining to me that
all
she wanted to know was if I actually work for the employer who holds my
visa. I told her that I will come back again with the letter.
DMV, Hamden, CT:
After obtaining a employment letter from my employer I chose to go
to DMV, Hamden, CT because it is close to my home. The issuing officer
looked at all my documents and then told me the employer letter was
unacceptable because it is generated by a computer. I asked him what
document is he actually looking for. He said he cannot accept a
computer
generated document. I was confused. Then he showed me my employer
letter
and told me he cannot accept it because it is printed from a computer.
I
told him it is generated from the computer so whats wrong with
employment letter generated from a printer connected to a computer. I
understood what he was trying to say. He just had concerns with the
validity of my employment letter.
Nothing wrong in having concerns about validity of employment letters.
He was just not able to express that to me. As I have the habit of
carrying all my documents, I showed all my legal documents like LCA
(that I am working in Shelton, CT) , my h1b documents etc... to make
him
comfortable of the fact that my employment letter is indeed valid. But
at this point he just did not want to listen or see anything instead he
kept arguing that this is CT and rules here are different and he would
not see any documents or papers and he only wants an employer letter.
And I told him that is right in front of his eyes. He says he cannot
accept it because it is a computer generated document.
Then I asked him what he really wants? He argued that he wants an
employer letter that is not a computer generated document but a actual
document. Then his collegue came to his resque and told me that he is
actually looking for a document that explains clearly the reason I am
in
CT and details of my work location from my employer etc... I asked him
to write it down in a piece of paper what he actually wants. His
collegue wrote down in a piece of paper that an employment letter
stating my work location as Shelton, CT is what they are looking for
and
I can get my out of state license transfer once I have that document. I
wanted a official letter from the issuing officer stating what they
really want and they were not willing to give me that. So I asked him
again what he wants next time. He said he wants a letter from my
employer that I am working in Shelton, CT and work details etc....

documentation required. The best thing to do to check validity of h1b
visa holders is to actually ask for recent paystubs and w2 forms. These
forms have employer names and if any H1b visa holder. If the issuing
officer has concerns with documentation validity of a h1b visa holder,
then the best thing would be to have a employment background check done
or look at paystubs and w2 etc... Or specify what kind of letter they
are looking from an employer so that they can be convinced that the
candidate is a valid visa holder.
Though I will be going back to the DMV sometime next week with letter
they requested for, I felt it is my duty to suggest to DMV a good
source
of validity for h1b visa holders.

The way USCIS functions, I would rather see the movement of the dates back rather than forward...why?
This is the time when USCIS actually TRIES to follow FIFO: meaning tries to work on old cases. Last quarter is usually a mess and approval pattern goes to TB to BB (top of the box to bottom of the box).
So, It is a actually a good thing, if PD stays there or moves back; that will make USCIS work on approving older cases at this time.
It is also a good sign that DOS mentioned that "they are waiting from USCIS for pending numbers": that means, they actually asked for those!!!!!! AND USCIS is working on it (or atleast told them so). This has been the crux of all the visa number movements including random approvals. If this is sorted out somehow, it will be a great deal of improvement in implementing FIFO system to some extent. If USCIS gives that info to DOS, there will be someone (DOS) to ask USCIS: WHY DO YOU NEED TO MOVE PD FORWARD TO 2008 WHILE YOU HAVE SO MANY THOUSANDS OF CASES FROM 2000-2005 PENDING??

My husband applied for his H1-B extension But we didnt receive approval notice.we have recipe copy.
Is there any chances to reject my h4visa(boz only 2-3 months left for my husband h1-b expiration)

my pd is march 07. my agency told me they converted my I 140 into premium on june 18.But my case status still hasn changed from 'RECIEVED N PENDING". Is there any delay by the uscis usually in changing the status?

I donot think I deserve $180/hr.... Right now I make $85K plus a 10% bonus.
You are missing the point. I do NOT think I am SPECIAL. I have an MBA from a US reputed Univ. plus 5 years of experience... I do assessment of their existing IT systems and give recommendations.
My logic is differrent.. This is valid for US born people too. WHY would a company pay $180 an hour to a consulting Co. for the same skill-sets.... however, when you go to them directly they will just pay you $60-$70.
I donot think I deserve $180/hr.... Right now I make $85K plus a 10% bonus.
You are missing the point. I do NOT think I am SPECIAL. I have an MBA from a US reputed Univ. plus 5 years of experience... I do assessment of their existing IT systems and give recommendations.
My logic is differrent.. This is valid for US born people too. WHY would a company pay $180 an hour to a consulting Co. for the same skill-sets.... however, when you go to them directly they will just pay you $60-$70.

Look at this part of Wall Street Journal :
HIGH-TECH EMPLOYERS get lift from House Republican letter to Speaker Pelosi urging passage of immigration bill to help "attract and retain" high-skilled workers. But in the poll, 56% of Republicans earning more than $75,000 annually would "strongly" or "partially" agree with candidate who would bar illegal immigrants from path to citizenship.
Look at this. Even when the conversation if totally on "high-killed workers", there is always and has to be always, a line or a sentence about illegal immigrants. Somehow, you cannot discuss anything about anything unless you have one line about illegal immigrants. The only sensible reason to discuss illegal immigration in same topic as "attract and retain" the "high-skilled workers" is that if there are people who are high-skilled, need to be "attracted and retained" and also happen to be "illegal".
So folks, look around yourself, do you find anyone who is "high skilled", "illegal" and also need better laws to be "attraced and retained". NASA folks and folks from silicon valley, please check the cubicle next to you to find an illegal rocket scientist or an undocumented microchip designer. Those damned illegal rocket scientists and doctors.
