A Quick Question.
Can parents stay here for 5 1/2 months go back for say a month or two and come back again for 5 1\2 months? Would this pattern be suspected during visa renewal?
if its a 10 year visa...i doubt there should be a concern about visa renewal.

I think we should call and tell them that highly skilled legal immigrants are working for long time and the jobs are granted because there is a shortage of highly skilled immigrants in US. We are waiting just because of the inefficiency of USCIS.

This legislation is similar to the measure that Sen. Robert Menendez (D-N.J.) used before Summer recess to hijack debate on E-Verify reauthorization. The bill�s sponsor, Immigration Subcommittee Chairman Zoe Lofgren (D-Calif), claims it would �recapture unused employer-sponsored visas� from as far back as 1991 and then add them to the current numerical cap of 140,000 employer-sponsored visas that are available each year. Current law, however, clearly states that any employer-sponsored visas not used in one year are allocated to the family-preference categories in the following year. That means that there are no �unused� visas from past years to �recapture.�
Moreover, these extra green cards would be for foreign workers to take engineering jobs, health care jobs, construction jobs, manufacturing jobs and just about every other job that Americans have been losing in this economy. In order to qualify, a foreign worker doesn't need more than 2 years of on-the-job training � and they aren't even required to have a high school diploma. Our country doesn't need these workers - our workers need these jobs!

I downloaded the 2004 file as you said and searched it, but could not find any information about my labor. Do you think the labor apps processed by backlog centers are in a separate file???

Spoke with Amit at USINPAC. Looks like the dude doesn't know any thing and might be a summer intern and Mr Robinder Sachdev is in India right now, I asked for his contact info and he doesnt have it right now. He is trying to get his contact information and also escalating with his higher ups. He said that he is receiving a lot of calls from IV members. Dont fire up on this guy. He is just taking calls. I told him that its unfair to grab/steal credit with out mentioning the source and also pointed out how IV has been renamed to Emigration Voice in the original story.
IV should have a own press release refuting their claims, if we do not hear from them in a day or two. That way we can expose them right away and stop them from doing so again in the future. Other wise, this might become a common thing for them

when a person applied his GC process 2002 EB3 with 3 years experience per say, another person 2004 EB2 with 5 years experience. How come EB2 guys is smarter then EB2. By the way lot of people in those days who applied under EB3 are well qualified and well educated. In my experience most of them are doing jobs that will easily comes under EB2.
The argument that Eb1 is preferred above Eb2 and BE2 is preferred over EB3 is absurd.
The regular yearly BE quota is distributed equally among all three categories, so then why they should not follow the same distribution for the overflow numbers?
Said that all BE3 applicants who are eligible should port there PD to EB2. Simple, when you know how the system works try to adapt to it.
Most of the EB3s who are in queue for more that 3 to 4 years may be eligible for EB2 porting (Assuming they got promotions and raises)

I spoke to the second level IO and he was confident that my case would have to wait for the next month. I insisted that the uscis website says otherways, he went and verified with the third level (or his peer) and came back and told me that I was correct.
Infact told me that my case was pre-adjd and being reviewed by IO currently.

I concur with the opinion of getting into IIT's is not a bench mark for success. It depends on what a person considers success. As far as "Best among best" is concerned, I used it only to compare the number of seats available for equally intelligent students in India and US. A student in India with similar aptitude, IQ and what ever comparable metrics has lesser chances of accomplishing what a student accomplishes in the US. let it be getting into IIT's or Ivy leagues.
